These Terms of Use (“Terms”) govern your access to and use of the NicotineAI mobile application, websites, and related services (collectively, the “Service”). By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.
NicotineAI is a behavioral support and self-management tool designed to help users track nicotine use, understand personal patterns, manage cravings, set goals, and receive personalized recovery guidance.
NicotineAI is not a medical provider, medical device, emergency service, or substitute for a qualified healthcare professional. Information, scores, timelines, estimates, AI-generated responses, recommendations, and recovery guidance provided through NicotineAI are for informational and behavioral-support purposes only.
Do not use NicotineAI to diagnose, treat, cure, or prevent a disease or to make decisions that require professional medical judgment. If you have a medical concern, severe withdrawal symptoms, a mental-health crisis, or an emergency, contact an appropriate healthcare professional or local emergency service.
You must be legally permitted to use the Service in your location and capable of agreeing to these Terms. You are responsible for information submitted through your account and for keeping your credentials secure. You must not impersonate another person or use the Service for unlawful purposes.
NicotineAI may use your logs, history, messages, preferences, and other information you provide to generate personalized insights, predictions, risk windows, recommendations, and coaching responses.
AI-generated and algorithmic outputs may be incomplete, inaccurate, delayed, or inappropriate for your specific circumstances. You remain responsible for your decisions and actions. NicotineAI does not guarantee that any recommendation will prevent a craving, prevent nicotine use, produce a particular recovery result, or improve a medical condition.
You retain ownership of information and content you submit to NicotineAI. You grant us a limited license to host, process, transmit, reproduce, and use that content only as reasonably necessary to operate, secure, maintain, personalize, and improve the Service, subject to our Privacy Policy.
You agree not to upload unlawful, harmful, infringing, malicious, or deceptive content or attempt to interfere with the operation or security of the Service.
NicotineAI may offer free and paid features. Paid subscriptions purchased through the Apple App Store are processed by Apple and are subject to Apple’s applicable purchase and subscription terms.
Before purchase, the app will display the subscription period and current price made available by the App Store. Subscriptions generally renew automatically unless canceled through your Apple subscription settings before the applicable renewal date.
Free trials: If a free trial or introductory offer is shown on the purchase screen and made available to your Apple ID, the offer applies for the period displayed by Apple or in the app at the time of purchase. Eligibility is determined by Apple and the applicable subscription configuration. Unless canceled before the trial ends, a trial may convert to a paid auto-renewing subscription at the displayed price.
You can manage or cancel an iOS subscription through your Apple ID / App Store subscription settings. Deleting your NicotineAI account does not itself cancel an Apple subscription.
Where supported by Apple, you may use the Restore Purchases function in NicotineAI to restore an eligible active subscription associated with your Apple ID.
Payments made through the Apple App Store are handled by Apple. Refund requests for App Store purchases must generally be submitted to Apple and are governed by Apple’s applicable refund policies.
You may not use NicotineAI to violate law, interfere with the Service, bypass security or subscription controls, reverse engineer protected server-side systems except where applicable law expressly permits it, distribute malware, scrape the Service at scale, or use the Service in a way that harms other users or our systems.
NicotineAI, including its software, design, branding, interfaces, models, scoring logic, proprietary recovery intelligence, documentation, and other materials we provide, is owned by or licensed to NicotineAI and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of NicotineAI intellectual property to you.
The Service may depend on third-party services such as Apple, Firebase, RevenueCat, hosting providers, and AI-processing providers. Their services may be subject to separate terms and privacy policies. We are not responsible for outages or actions outside our reasonable control.
We may modify, add, remove, suspend, or discontinue features of NicotineAI. We do not guarantee that every feature will always be available, error-free, or compatible with every device.
We may suspend or terminate access when reasonably necessary to protect the Service, comply with law, respond to fraud or abuse, or address material violations of these Terms. You may stop using the Service at any time and may delete your account through the in-app account settings.
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties that are not expressly required by applicable law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, NicotineAI and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, opportunities, or goodwill arising from use of or inability to use the Service. Nothing in these Terms excludes liability that cannot legally be excluded.
To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the Service or material violation of these Terms.
Your use of the Service is also governed by the NicotineAI Privacy Policy. The Privacy Policy explains how we collect, use, retain, disclose, and delete personal information.
We may update these Terms from time to time. If a change is material, we may provide notice through the Service or by other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
These Terms are governed by the laws applicable to the operator of NicotineAI, without regard to conflict-of-law principles, except to the extent consumer-protection law in your place of residence requires otherwise.
